ItemComparative Study of the Concept of the Welfare State According to Liberal, Islamic and the 1945 Constitution(https://journal.uin-alauddin.ac.id/index.php/Jurisprudentie/index, Repository STAIN Majene, 2022) Abdul Rahman ; Nur Akifah Janur ; ArdiansyahThis research aims to elaborate the thinking between the concept of the welfare state and the current understanding of democracy in Indonesia. the research used is normative legal research using a conceptual approach. The research results show that the concept of the welfare state emerged as an alternative to constitutional democracy in the 20th century, which was a reaction to the influence of liberal pluralism in the 19th century. This thinking gave rise to the proposition "the least government is the best government". The Welfare State is currently proven to be able to develop the economy while increasing the standard of living of the people. The current crisis of the welfare state, which is often debated, both in Europe and the United States, is not about its existence, but only about its size and capacity. The welfare state is nothing new in Islam. Before being implemented in the West, the Islamic world practiced it first.

ItemGOVERNMENT LEGAL POLICY AND SOCIETY'S ROLE IN OVERCOMING THE PRACTICE OF COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN(https://www.russianlawjournal.org/index.php/journal, Repository STAIN Majene, 2023) Abdul Rahman ; NURFAIKA ISHAK ; NUR AKIFAH JANUR ; ARDIANSYAH ; Aminuddin ; NUZHAAbstract – The practice of commercial sexual exploitation of children (CSEC) in several areas in South Sulawesi Province is a phenomenon that is very troubling to the community. The government has been faced with many problems that have damaged the future of children. This study aims to determine the form of CSEC and analyze government legal policies and the role of society in preventing the practice of CSEC. This is empirical legal research with data sources from government officials and the public. CSEC covers prostituted children, child pornography, trafficking of children for sexual purposes, child sex tourism, and child marriage in certain cases. Responding to the widespread practice of CSEC, the government and society have taken several legal steps to overcome the practice and prevent the consequences that arise through counseling and law enforcement, especially against the perpetrators

ItemMAJELIS TA'LIM AS SOCIALIZATION MEDIA OF CHILD PROTECTION IN WEST SULAWES(Article received February 25th, 2021; Article revised April 13th, 2021; Article approved May 8th 2021, 2021-05-08) Anwar Sadat ; Abdul RahmanThe enactment of Law No. 35 of 2014 concerning Child Protection is intended to protect children and guarantee their rights to live, grow, develop, and participate optimally following human dignity and get protection from violence and discrimination. It could be achieved through increasing awareness of the rights and obligations and the responsibility of the involved parties, especially parents because they are the first and foremost in contact with children. In the context of the Law socialization, research is needed to find an appropriate and effective socialization model especially for women (mothers) through religious-social activities. One of them is majelis ta'lim program. This research used a normative-empirical research type. Normative research was used through the interpretation of grammatical and authentic legal methods. Empirical research was conducted by a teleological interpretation method to know the extent of the legal norm according to the community’s attitudes, behaviors, and compliance. Data were collected through the study of literature and empirical studies using interview guidelines and questionnaires. The research results showed that the developed socialization model could solve the most fundamental and urgent literature and the wider community’s interests. In protecting the community-based program, the issue is not merely children in conflict with the law. It includes a larger unit of interaction, such as parents, family, peers, environment, and wider social institutions

Orang yang percaya pada hukum (law enforcement) berharap lewat jalur hukum perjuangan mereka menemukan jalan keluar. Kepercayaan itu ada benarnya sebab hukum dianggap sebagai mekanisme terbaik dalam mengatur masyarakat agar kehidupan bisa berjalan secara adil dan manusiawi. Adil dan manusiawi, bila perempuan tidak ditempatkan pada posisi marjinal dalam kehidupan masyarakat. Penghapusan kekerasan terhadap perempuan hanya bisa tercapai bila ada pengakuan kesetaraan dan keadilan tanpa adanya diskriminasi terhadap perempuan dalam berbagai aspek kehidupan, untuk itu menjadi suatu keharusan adanya kebijakan pemerintah secara lebih tegas yang mengaturnya serta meratifikasi kovenan internasional tentang masalah-masalah perempuan termasuk mengeliminasi budaya patriarkhi. Disisi lain, upaya tersebut seringkali berhadapan dengan berlakunya budaya patriarkhi yang kuat dalam masyarakat.

ItemRELEVANSI PIDANA BERSYARAT DENGAN TUJUAN PEMIDANAAN INTEGRATIF DI INDONESI(https://jurnal.stainmajene.ac.id/index.php/qisthosia/index, Repository STAIN Majene, 2021-06) Abdul RahmanPidana bersyarat adalah pidana pokok yang telah dijatuhkan oleh hakim berupa pidana penjara, yang pelaksanaannya tidak segera dijalani dalam tembok lembaga permasyarakatan, melainkan (hanya) di tengah-tengah masyarakat, dengan syarat selama masa percobaan yang telah ditentukan oleh hakim, terpidana bersyarat tidak boleh melakukan pelanggaran.Untuk menyesuaikan usaha pendayagunaan pidana bersyarat di dalam kerangka pembaharuan hukum pidana yang berprikemanusiaan dengan falsafah negara Pancasila dan Undang-undang Dasar 1945, maka seharusnya diusahakan agar pengaturan dan penerapan pidana bersyarat secara integratif dapat memenuhi perangkat tujuan pemidanaan berupa pencegahan, perlindungan masyarakat, memelihara solidaritas masyarakat dan pengimbalan. Keuntungan penerapan pidana bersyarat antara lain: memberikan kesempatan kepada terpidana untuk memperbaiki dirinya di masyarakat, b) memungkinkan terpidana untuk melanjutkan kebiasaan-kebiasaan hidupnya sehari-hari sebagai manusia, yang sesuai dengan nilai-nilai yang ada di masyarakat,; serta c) akan mencegah terjadinya stigma yang diakibatkan oleh pidana perampasan kemerdekaan sebagai salah satu konsekuensi di luar hukum yang harus diperhitungkan dalam kebijaksanaan para penegak hukum
